Waiver & Assumption of Risk

This page explains the risks of paragliding and the liability terms you accept when you train and fly with Infinity Sky. Please read it carefully before you book.
Warning
Paragliding and all related activities are inherently dangerous and may result in serious injury or death. No amount of care, instruction, equipment, or experience can remove this risk. Every participant, whatever their level, has final responsibility for their own safety.
1. The activities this covers
“Paragliding Activities” means ground handling, ground school, tandem flight, solo flight, instruction, the use of equipment, transport to and from launch and landing sites, retrieves, and any related activity organised or facilitated by Infinity Sky, together with our instructors, staff, assistants, partners, and the owners of the land and sites we use (the “Released Parties”). Infinity Sky is operated by its founder as a sole proprietor (individual entrepreneur) registered in Georgia. Full legal registration details are available on request.
2. The risks you accept
Paragliding Activities take place outdoors and abroad, in mountainous terrain, and carry risks that include but are not limited to:
- falls, collisions, hard landings, and loss of control of the wing;
- changing and unpredictable weather, turbulence, and thermals;
- equipment behaving unexpectedly, or failing;
- terrain hazards — cliffs, rocks, water, trees, power lines;
- injury during transport, on launch, or on landing;
- high altitude and altitude sickness, sun, heat, cold, and dehydration;
- remote locations where medical care, rescue, and evacuation may be limited, delayed, or expensive;
- the conduct of other participants and of third parties.
Because our camps take place abroad and involve travel, you also accept the general risks of international and adventure travel, including but not limited to:
- air, road, and other transport — delays, accidents, and breakdowns;
- foodborne and waterborne illness, infectious disease, and other illness;
- insects, animals, and plants;
- theft, loss, or damage to your luggage and personal property;
- local conditions such as crime, civil or political unrest, and natural events.
You understand these risks may result in injury, illness, pain, disability, or death, and that the unforeseen can happen. You accept that these travel and health risks are yours to bear, together with your own insurer, and are not the responsibility of the Released Parties.
3. Statement of medical fitness
By taking part, you confirm that:
- you are in good physical and mental health and fit to participate;
- you have disclosed to us, in advance and in writing, any condition, medication, injury, or pregnancy that could affect your safety or ability to fly;
- you are within our equipment weight range of 99–265 lb (45–120 kg);
- you will not participate under the influence of alcohol or drugs.
We may decline your participation, or require a doctor’s clearance, where this is reasonably necessary for safety.
4. Assumption of risk
You voluntarily choose to take part in Paragliding Activities with full knowledge of the risks, and you expressly and voluntarily assume all risk of injury, illness, death, and property loss arising from your participation, whether the risks are known or unknown, foreseeable or unforeseeable.
5. Release of liability
To the fullest extent permitted by applicable law, you release the Released Parties from claims, demands, and causes of action arising out of your participation in Paragliding Activities, including those arising from ordinary negligence of the Released Parties, and you agree not to sue them for such claims.
6. Indemnification
To the extent permitted by law, you agree to hold the Released Parties harmless from third-party claims and reasonable costs that arise from your own acts, omissions, or breach of these terms during Paragliding Activities.
7. Responsibility to third parties
You are solely responsible for any injury, death, or loss you cause to other people, and for any loss of or damage to property belonging to others, arising from your own acts, omissions, or negligence during Paragliding Activities and the trip. Any such matter is strictly between you and the affected third party; the Released Parties are not a party to it and bear no responsibility for it. To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold the Released Parties harmless from any claim, demand, damage, cost, or expense (including reasonable legal fees) made by a third party in connection with such injury, death, loss, or damage.
8. Equipment
During training you fly only on our certified school equipment or on new certified equipment purchased through us — not on your own or third-party used gear, for safety. You agree to use equipment with care and to be responsible for loss or damage caused by your misuse or negligence.
9. Insurance — your responsibility
Valid insurance is required — it is not optional. You arrange and pay for your own cover. Before any flying you must hold travel/medical insurance that:
- covers paragliding undertaken under instruction (including tandem and supervised solo flights);
- includes emergency medical treatment, emergency medical evacuation, and repatriation, with a minimum of US$1,000,000 for evacuation/repatriation and at least US$250,000 for emergency medical expenses;
- is valid in Colombia (or the relevant camp country) for the dates of your camp.
You must send us proof of cover before the camp and keep it with you during the camp. Participants without adequate proof of insurance will not be permitted to fly, and no refund is due for days missed for that reason.
10. Photos and video
During camps we may take photos and video that include you, for coaching and for our own promotional use. If you would prefer not to appear in promotional material, tell us in writing and we will respect that.
11. Governing law
The signed on-site waiver is governed by the law of the country where the relevant camp takes place. Where any part of a release is found unenforceable, the remainder stays in effect to the fullest extent permitted by law.
12. Acknowledgement
